If you are considering a Lasting Power of Attorney, one of the first practical questions is usually the cost.
For Brooks Wills clients, the current professional fees are:
- One LPA: £275 including VAT.
- Both types of LPA for one person: £500 including VAT.
- Both types of LPA for a couple: £900 including VAT.
The Office of the Public Guardian (OPG) registration fee is separate. As at October 2026, it costs £92 to register each LPA. That means somebody putting both types of LPA in place will normally have two separate OPG registration fees.
This guide explains what those figures mean, what Brooks Wills’ professional fee includes, how the DIY route compares, and what to look at when comparing LPA prices.
What are the two types of Lasting Power of Attorney?
There are two types of LPA in England and Wales, and they cover different decisions.
Property and Financial Affairs LPA
This can give your chosen attorney or attorneys authority to deal with financial matters such as bank accounts, bills, pensions and property.
When you make this type of LPA, you can choose whether your attorneys may act as soon as the LPA is registered, with your permission while you still have mental capacity, or only if you later lose capacity.
Health and Welfare LPA
This covers decisions about matters such as medical treatment, care and where you live. Attorneys can only make a particular health and welfare decision when you lack the mental capacity to make that decision yourself.
Some people decide that one type is enough for what they want to plan for. Others choose both because financial decisions and health and welfare decisions are separate.
How much does Brooks Wills charge for an LPA?
The current Brooks Wills professional fees are:
| Service | Brooks Wills professional fee | OPG registration fee |
|---|---|---|
| One LPA | £275 including VAT | £92 |
| Both types of LPA for one person | £500 including VAT | £184 in total |
| Both types of LPA for a couple | £900 including VAT | £368 in total for four LPAs |
The OPG fees shown above are payable separately from the Brooks Wills professional fee.
What is included in the Brooks Wills professional fee?
The professional fee covers more than completing a form. The current Brooks Wills service includes:
- an initial consultation to understand your circumstances;
- clear, plain-English guidance;
- preparation of the documents;
- an opportunity to review your drafts;
- amendments before completion where needed;
- guidance through signing and witnessing;
- an explanation of registration or the next steps where relevant;
- support throughout preparation and completion; and
- VAT.
This can be particularly useful if you want help deciding who to appoint, how more than one attorney should make decisions, whether replacement attorneys are sensible, or whether particular preferences or instructions need to be considered.
How much is the Office of the Public Guardian registration fee?
As at 17 November 2025, the OPG charges £92 to register each LPA.
Because the two types of LPA are separate documents, somebody registering both types normally pays £184 in total. A couple registering both types for each person would normally have four registration fees, totalling £368.
Help with the fee may be available in some circumstances. Current government guidance says a 50% reduction may be available where the donor’s income before tax is below £12,000 a year, and an exemption may be available for some means-tested benefits. Eligibility should be checked against the current GOV.UK guidance when the application is made.
Can you make an LPA yourself?
Yes. You do not have to use Brooks Wills, a solicitor or another professional provider to make an LPA. The government provides forms and an online service for people who want to prepare their own documents.
For somebody with straightforward circumstances who is comfortable making the decisions and following the signing and registration process, the DIY route may be perfectly reasonable.
The trade-off is that you are responsible for understanding the choices in the document, completing it correctly and making sure it reflects what you want.
Why do professional LPA prices vary?
Different providers can charge different amounts because the service included may not be the same. A useful comparison therefore looks beyond the headline fee.
Before choosing a provider, consider asking:
- Is VAT included?
- Are OPG registration fees included or separate?
- Is there a proper discussion about your circumstances?
- Will the different ways attorneys can act be explained?
- Will replacement attorneys be considered?
- Can you review the draft before signing?
- Is guidance on signing and witnessing included?
- What support is available if something needs changing before completion?
A lower price is not automatically a poor choice, and a higher price is not automatically better. The useful question is whether the level of service is appropriate for what you need.
Do you need both types of LPA?
Not necessarily. The two documents do different jobs.
If your concern is mainly about financial matters, you may decide that a Property and Financial Affairs LPA is your priority. If you are thinking about future care, medical treatment or where you might live, a Health and Welfare LPA deals with a different set of decisions.
Many people choose both, but it should be a considered decision rather than an assumption that everybody needs the same package.
When might professional support be worth paying for?
Professional support may be useful if you want somebody to explain the choices, prepare the documents, check the details and guide you through completion.
It may be particularly helpful where there are several attorneys, replacement attorneys, family complications, particular preferences or instructions, or simply uncertainty about how the different options work.
Equally, if your circumstances are straightforward and you are confident using the government process yourself, professional support may not be necessary. That is an important part of comparing the cost fairly.
How should you compare LPA costs?
A simple way to compare providers is to separate the total cost into four parts:
- How many LPAs are being prepared? One LPA, both types for one person, and four LPAs for a couple are different pieces of work.
- What is the professional fee? Check whether VAT is included.
- What government fees are payable? The OPG registration fee applies to each LPA and may be quoted separately.
- What service is included? Compare the discussion, drafting, checking, signing guidance and support you will actually receive.
This makes it much easier to compare like with like.
